As if patent wars couldn’t get any crazier, some companies seek “justice” even with the absence of products in violation. The sue happy company known to many as Apple, has struck again, this time bringing up the past, and Samsung is the target.

Patents are essentially a piece of paper. That paper allows for a company to have rights on an invention, making it illegal for other companies to duplicate. This is a great way to protect inventions and ideas, but in the world of technology, it becomes something different. The rate of which technology advances, is unbelievable at times, and new ideas are always coming to fruition. From a business aspect it makes sense, but from a consumer point of view, it is a way for the company to ensure that we buy their product over another. The problem with the logic, is that many of us don’t buy a device based on one thing, one feature or material used. Apple seems to attack this issue in a different way. They tend to patent anything they can, to make sure no one has what they have. Giving us, the consumer fewer options to choose from when we go shopping for a new device.

This is the case for Apple vs. the world, but right now we are talking about Apple vs. Samsung. In November of 2013, Apple was awarded the chance to re-file a suit against Samsung. Apple took that chance, and asked U.S. District Judge Lucy Koh, to oversee the end of sales in the U.S. of the Samsung devices in question. The suit would ban around 20 Samsung devices that infringed upon a design and utility patent held by Apple.

Amongst the 20 devices were smartphones and tablets alike, the part that may blow your mind, so get ready, is that the devices have since been pulled from store shelves in the U.S., where the suit applies. That’s right, it is no longer possible to get the product pulled off the shelves, instead it seems to be more of a principle thing, a way to punish Samsung so that they learn their lesson. Foss Patents shows the official filing, and in the details of the suit, Apple had this to say, “Samsung’s claim that it has discontinued selling the particular models found to infringe or design around Apple’s patents in no way diminishes Apple’s need for injunctive relief,”.

This has become more than a war to Apple, this seems to be personal, and a way for them to show everyone, they are not safe. Apple wants to be sure that Samsung doesn’t try and “infringe” on their patents again. Samsung, has no choice currently but to show any workarounds they may have for the patent infringements, even if they aren’t selling the devices anymore. Samsung said they have them in the works, but have yet to unveil them.

You may not have heard but Apple introduced something called the iPad today. There are plenty of places for you to read about the not-shipping-for-two-months iPad, and I havent had my hand(s) on one yet, so rather than write about it myself Im just sending you a few links.

It certainly looks like an interesting device. Two things that jump out at me: Apple used its own chip to power the iPad-- they did not use an Intel chip, nor an AMD chip, nor any other kind of chip. Ive always liked apple chips, by the way, though I prefer banana.

The other thing that jumps out at me is the lack of a camera. I sort of think it ought to have one. So much for doing video chats with it.

I wonder if it can print. Ill try to find out.

Exhibit A -Some Gold phones from Samsungs Past  

Some pundits have been wading into Samsung for "copying Apple" by releasing a gold version of its Galaxy S IV right after Apple released and then quickly sold out of its gold iPhone 5S.
"If recent reports are correct, the demand for the gold version is higher than Apple expected. Of course Samsung wanted in on the action," wrote TechCrunch.

Cult of Android cheekily asks: "does this company [Samsung] have any shame?"
The main theme appears to be that Samsung blatantly copied Apples glorious winning strategy by releasing a gold Galaxy S IV right after Apple.
But if we are going to get into a juvenile peeing contest about gold plated phones, it may surprise commentators to discover it was Apple that copied Samsung.

Samsung released a gold smartphone in August, weeks before the gold iPhone 5S came out. It was called the Galaxy Golden and it was a pig-ugly hybrid flip phone-smartphone.

It had two 3.7-inch AMOLED displays with WVGA resolution, a 1.7GHz dual-core processor, an 8-megapixel rear camera, a 1.9-megapixel front-facing camera, LTE support, a 1,820 mAh battery and the Android 4.2 Jelly Bean operating system.
But what was more important was that it shipped in a "champagne gold" colour. It seems that Samsung has been thinking about Gold
phones for a while now, long before Apple showed off its first sample.
Then again, like the rectangle with rounded corners, gold isnt really something that belongs to either of the quarrelling companies. Dont expect that to stop them and their fans from fighting about it, though.

Apple just went on record, announcing the traditional launch weekend sales report of the new iPhone model. This year it combines both the flagship iPhone 5s with Touch ID fingerprint sensor and new camera mojo, as well as the flashy plastic iPhone 5c, which sells for twice less on contract.

This time Cupertino broke its own sales record by a huge margin, reporting that it moved 9 million of the handsets, most of those since Friday. The previous record was, you guessed it, the iPhone 5 last year, with 5 million of those sold in the first three days after launch.

Now, we have to account that this time Apple is selling two models at various price points, but judging from the 3:1 activation ratio numbers that Localytics just posted, the iPhone 5s should have sold about 7 million, while the 5c chips in with roughly 2 million units.

Apples shares are up to 6% premarket, and the folks at Cupertino also reported that over 200 million devices are already running iOS 7, "making it the fastest software upgrade in history".

Tim Cook, Apples CEO, who personally was meeting and greeting people buying the new iPhones at the Palo Lato store over the weekend, did a little song and dance:

This is our best iPhone launch yet--more than nine million new iPhones sold--a new record for first weekend sales. The demand for the new iPhones has been incredible, and while weve sold out of our initial supply of iPhone 5s, stores continue to receive new iPhone shipments regularly.
